Following on from the post i made the other day about Santa Cruz´s legendary artist Jim Phillips gettin ripped off by a fashion designer, i happened to me yesterday too.
check out this lady´s Etsy store´s $90 wall vinyls and my original drawing from 2009. notice anything?
pissed me right off!

You have your signature on every "property" you created so you have a very strong ground, I think...

You didn't mention what you wrote to them, but I don't think agressive or threatening words are useful in this case. Based on the "womans" response, the company sounds like it receives things like this on daily basis and it knows how to deal with it "legally"...

I haven't read all of it but this page (about copyright and intellectual property policy) tells me that they are aware of what they are doing (i.e. where they are sourcing their "properties" legaly, maybe through the US intellectual property law loophole) and they sound like they are prepared full throttle for any legal action against them (http://www.etsy.com/help/article/482?ref=ft_copyright).

Be careful how you word your concerns...I'm not familiar with such law but I'm sure fellow weeders will have arrays of solution for this.

I'm devastated to hear that this has happened to you. Keep us posted on how you're getting on.

Theres electronic creation dates on all the stuff you do which cant be altered. When I used to make music youd send a copy of a dat/cd/cassette via recorded delivery to yourself (used to baffle the postys) and leave it unopened, that way if it goes to court the judge can open it and check the date stamps on it etc. You have CC on anything you do anyway.

Theres some graphics in Morrisons on the trolley bays that looks a lot like you stuff?

Original artwork does not need a name or copyright symbols. Therefore if it is copied it is down to the owner to determine how they want to proceed. I do know a colleague who had a similar predicament and it ended up costing the person £3K ish in court due to an advert being used in a regional magazine.

Personally I would be looking to discuss this legally with the person. If you have legal insurance I would consider using this!

thanks for replies and support and advice. At least the product has been removed. there´s been some "interesting" communication, amazing how quickly people change when you mention money.....

hi--result was she took the product down immediately , and at this point she was quite nice and apologetic and sending me lots of aloha etc (blamed the intern, just like Clinton!). I wrote to her asking how many she´d sold and claiming i should receive the money from these sales and that seemed to change her attitude- she got really defensive and arsey with me ad started threatening me with attornies and law enforcement (!) because some people had written some not very nice messages about her company on my facebook page- what an idiot! obviously i have no control over what people write on a public page, and she was the one in the wrong!

Anyway, (as she probably guessed) i didnt have the time, money or inclination to start a legal case in America for a few dollars so i left it at that, a lot of people say getting the offending design removed is an achievement is the best i could have hoped for- so that´s that.

Although.... i just got ripped again by this film production company in the US- cant believe people (especially fellow ´creatives´) think it´s ok to just find something on the net and use (steal) it without paying! :evil: :evil: :roll:
